The Rohini court has denied compensation to the individual’s relative when the individual was involved in an accident with a car. Reportedly, the individual was riding his motorcycle on the wrong side of the road when he collided with a car. The individual died because of the accident.
The presiding officer of the Motor Act Claims Tribunal said that the victims who are found to be driving on the wrong side of the road are not entitled to any compensation. The court said that it does not matter how serious the accident and the injuries are. This is because they were driving or riding on the wrong side of the road which is breaking the law and is very dangerous.
The accident that we are talking about happened at 2 AM. The driver who was driving on the right side of the road was following the speed limit and he was not expecting a vehicle to come from the wrong side. In the accident, the motorcycle which was going the wrong way collided with the car and the pillion on the motorcycle died whereas the rider himself was injured severely.

Then the family of the deceased wanted that the car driver should pay compensation. The family also said that the car driver was driving negligently and in a rash manner. But the court said, “The car was being driven within the permitted speed limit… It would not be right to put the blame of the death on the car driver or its owner.” Moreover, the court says that it is not fair to seek compensation from the car driver based on the way the family is reporting the accident. The driver of the car said before the court that has has been wrongly pulled by the victim’s family because he was driving on the right side of the road when the accident happened at night.
Driving on the wrong side is dangerous
Needless to say, driving on the wrong side of the road is very dangerous. The accident mentioned above is a perfect example. The vehicle coming from the front doesn’t need to be able to spot you if you are not using the headlamp. And if you are using the headlamp then it can blind the vehicle’s driver who is driving on the right side of the road. Moreover, people driving on the wrong side of the road are unpredictable because of which people driving on the right side can also make an unpredictable manoeuvres.
Wrong-side driving will lead to FIR, vehicle seizure and court appearance
In March, Mumbai Police announced that a person who is caught driving on the wrong side will be booked for rash driving and negligent driving. He or she would also have to appear before the court and the vehicle will also be seized. Police Commissioner, Sanjay Pandey said, “Those caught for driving in the wrong direction will be booked under relevant provisions of the Indian Penal Code or Motor Vehicles Act,”
