Judge Dismisses Sexual Misconduct Lawsuit Against Warren Beatty

A judge nixed the lawsuit with prejudice Friday after plaintiff Kristina Hirsch lost her lawyer and failed to meet a filing deadline

The lawsuit that accused Warren Beatty of sexual misconduct in 1973 was dismissed with prejudice on Friday, meaning plaintiff Kristina Hirsch cannot refile the case.

Los Angeles County Superior Court Judge Edward B. Moreton, Jr. terminated the case after Hirsch filed a declaration in largely illegible handwriting and failed to meet a court deadline for a case management statement. Hirsch called into a Friday morning hearing remotely without being represented by a lawyer, according to a minute order posted on the court’s website.

Hirsch’s previous lawyer asked to be relieved as her counsel earlier this year. The lawyer hinted at a breakdown in communication when he told the court he was unable to confirm Hirsch’s physical address. The lawyer offered to file something “under seal” if the judge wanted more information on the reason for his withdrawal request.

Hirsch did not immediately respond to a request for comment from Rolling Stone. Beatty was never served with the lawsuit and never filed a response.

It was in November 2022 that Hirsch sued Beatty with a complaint that didn’t name him specifically but clearly revealed his identity by describing the defendant as having been nominated for an Academy Award for his role as Clyde in Bonnie and Clyde.

Hirsch claimed the actor had coerced her into sex decades earlier. A rep for Beatty did not respond to a request for comment.
