Dua Lipa Wins Dismissal Copyright Lawsuit Over Her Levitating Song
A copyright breach lawsuit against Dua Lipa, songwriters Clarence Coffee Jr., Sarah Hudson, and Stephen Kozmeniuk, as well as Warner Records, was recently dismissed by a federal court in Los Angeles. The lawsuit alleges that Lipa’s hit song Levitating copied elements of “Live Your Life” from 2017 by Florida reggae group Article Soundsystem.
U.S. District Judge Sunshine Sykes on Monday approved the famous singer’s motion to dismiss the case, in which it is said that the article Sound System failed to provide sufficient evidence that the authors of Levitating had access to their songs.
The judge rejected the group’s contention that the music was streamable and had been performed live in Florida, despite their assertions to the contrary.
The court found that Artikal Sound System’s claims on the number of CDs sold, as well as the frequency and location of their performances, were unspecific and insufficient. However, Artikal Sound System was given permission by the honourable judge to submit a new, modified complaint by June 16 in order to enhance their position.
In their 2022 court documents, the organisation first demanded income from “levitating” as well as damages. The dismissal marks a temporary victory for Dua Lipa and the other defendants in the case.
