Jamie Foxx Sued for Alleged Sexual Assault at NYC Restaurant

Jamie Foxx is being sued for sexual assault that allegedly took place eight years ago at a rooftop bar eight years ago.

According to the lawsuit obtainer by Rolling Stone, the woman, identified in the filing as Jane Doe, alleges that the Foxx, whose real name is Eric Marlon Bishop, pulled her into a back area of Catch NYC rooftop lounge and groped her breasts and underneath her pants against her will.

The woman claims that she and a friend had been seated at a table near Foxx and Mark Birnbaum, the owner of the bar. At approximately 1:00 am on Aug. 27, 2015, per the filing, the plaintiff’s friend walked over to Bishop and asked if he would take a photo with them. According to the suit, Bishop said, “sure baby anything for you,” walked over to Jane Doe’s table where several photos were taken, and told the plaintiff, “Wow, you have that super model body” and “You smell so good.” The filing also states that he said she resembled Gabrielle Union.

The plaintiff claims that Bishop pulled her by the arm and led her to a more secluded area, where he began rubbing her breasts beneath her crop top and that when she tried to step away, he slid his hands down her pants and “put his fingers on and in Plaintiff’s vagina and anus.”

The suit alleges that the plaintiff’s friend walked over looking for her and at that point, Bishop stopped touching her. According to the filing, a security guard witnessed the incident but walked further away. Birnbaum and Catch NYC are also listed as defendants in the suit.

The woman claims she “suffered and continues to suffer severe emotional distress and anxiety, humiliation, embarrassment, post-traumatic stress disorder and other physical and emotional damages” and is seeking damages.

A representative for Bishop did not immediately respond to Rolling Stone‘s request for comment.
